Terms of Service

This document describes the Terms of Service (”Terms”) of Giix Realm, a paid service exclusive to VRChat (”VRC”, the ”Platform”) users. The customer (”you”, the ”commissioner”) understands and agree these terms once they order an avatar commission. This service is provided by Giix (the ”Artist”). These terms are subject to change at any time, and we will inform you of any modifications at least 30 days prior to their implementation. For minor changes, we may not provide a specific notification, but the updated terms will be available on our website and will be effective immediately upon posting.

0. Requirements to order

Customer must specify the desired design for the avatar, and confirms that has rights to own such avatar (e.g. license key). Order may be rejected or cancelled by the Artist if the customer doesn’t have a proper license of the commissioned avatar base. By order a commission, customer also agrees that they have a legal age (over 18 years old).In case the Artist doesn’t have a valid license of the requested avatar base to edit, the Artist have the right to charge an extra of the 50% of the base price of the requested avatar base. This extra fee is to compensate the cost of the license purchase for the Artist. License cost compensations are non-refundable.For example, if a customer wants to order a base which costs $50 in a storefront but the artist doesn’t have a license of that base, the Artist will charge an extra of $25 to compensate the purchase of the license for the Artist.

1. Refunds

You may cancel a commission and ask for a refund at any time. If no work has begun on the commission, I will provide a full refund. If work has begun on the commission, I will refund the unfinished portion but cannot refund completed work.

2. Termination

The Artist reserves the right to terminate or cancel any commission order at their sole discretion. In such cases, the Artist will provide a full refund (100%) of the amount paid in the Invoice to the customer. This termination can occur at any stage of the commission process. The termination will end the avatar’s warranty (extended support) too.Reasons for termination may include, but are not limited to:- Violation of these Terms of Service.
- Inappropriate or harassing behavior towards the Artist.
- Technical limitations or unforeseen circumstances.
- Artist's personal circumstances or availability.
Customer will receive a notification if such situation arises.

3. Post-Showtime Maintenance

After a commission is completed and delivered, any subsequent modifications or changes requested by the customer will be considered "Post-Maintenance" work. These modifications will be treated as sub-commissions and will require a separate invoice.Post-maintenance big changes start at a minimum price of 10 USD, with the final cost depending on the complexity and scope of the requested modifications. The Artist reserves the right to adjust the price accordingly based on the work required. Post-maintenance big changes includes but not limited to:- Major texture modification
Asset reconfiguration, except bad configured ones by the Artist.
- Asset addition, and depending of the license type of the asset an extra fee might be added.
- Major expression menu modification, e.g. Relocate folders and parameters.
- Major expression gestures modification, e.g. Relocate expressions or modify many expressions.
- To request post-maintenance changes, customer should contact the Artist with specific details about the desired modifications. A new invoice will be generated and marked as a "sub-commission" for the requested changes.
The customer has the right to request a .unitypackage file of their commissioned avatar. This package will contain all the modifications and changes made by the Artist. The customer is free to share or deliver this package to another avatar artist if they wish to make further modifications or changes to their avatar.The .unitypackage file will be provided upon request at no additional cost, as it is considered part of the commissioned service. However, the Artist is not responsible for any modifications or changes made by third-party artists using this package.

4. Copyright and protected content

The Artist cannot accept commission orders that involve copyrighted content or third-party fursonas without explicit written consent from the copyright holder or the original creator. This includes but is not limited to character designs, artwork, and other intellectual property owned by third parties.If a completed commission is found to contain protected content, the copyright holder or third party should contact either the Artist directly or VRChat, Inc. to review the situation. Upon verification of the copyright claim, the copyrighted content will be removed from the Platform. The Artist reserves the right to modify or remove any commissioned work that is found to infringe on copyright or intellectual property rights.The customer is responsible for ensuring they have the necessary rights or permissions to use any third-party content in their commission requests. Failure to do so may result in the termination of the commission and potential legal consequences.Fair-use of the protected content still apply to this, customer will have to give credits to the protected content.

5. Misuse of content

The Artist is not responsible for any penalties, bans, or account restrictions imposed by VRChat on the customer's account due to misuse of the commissioned avatar. The customer is solely responsible for adhering to VRChat's Terms of Service and Community Guidelines when using their commissioned avatar.Additionally, the customer acknowledges that due to the nature of the Platform, avatars can potentially be "ripped" (copied without authorization) by users. To minimize this risk, the Artist strongly recommends using public avatars when in public instances, reserving commissioned avatars for private or trusted instances.The Artist cannot guarantee protection against unauthorized copying or ripping of avatars, as this is a limitation of the Platform itself. The customer assumes all risks associated with using their commissioned avatar in public spaces.

6. Private avatars

Due to VRChat Terms of Service, the Artist cannot upload private avatars directly to the customer's VRChat account. Instead, customers must upload their commissioned avatars themselves using the provided .unitypackage file by the Artist. The Artist can provide guidance and basic instructions to help customers through the upload process, but the final upload must be performed by the customer themselves.

7. Payment methods

The Artist accepts payments through PayPal for all invoices expressed in United States Dollars (USD). These payments must be completed before the Artist begins work on the commission.The Artist will not begin any commission work until the payment has been successfully processed and confirmed through one of these approved payment methods.

8. Contacting each other

During the commission process, both parties must maintain communication to ensure the successful completion of the commissioned work. The Artist has the obligation to complete the commission as ordered by the customer, providing work-in-progress (WIP) screenshots throughout the process to demonstrate progress.The customer shall contact the Artist or Manager directly if they have any inquiries, feedback, or questions regarding their commission or these terms of service.
